1. INTRODUCTION
Welcome to Kami ("Kami," "we," "us," or "our"), an AI companion application that operates locally on your device. Kami is developed and operated by Adarsh Dev ("Developer"), accessible via the domain www.mykami.in (the "Website").
These Terms of Service ("Terms" or "Agreement") constitute a legally binding contract between you ("User," "you," or "your") and Kami governing your access to and use of the Website, the Kami Progressive Web Application ("App"), and all related services provided by Kami (collectively, the "Services").
BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
2. ELIGIBILITY
You must be at least 18 years of age, or the age of majority in your jurisdiction (whichever is higher), to use the Services. By using Kami, you represent and warrant that:
- You have reached the age of majority in your jurisdiction and can form legally binding contracts;
- You are not barred or restricted from receiving the Services under the laws of India, the United States, or any other applicable jurisdiction;
- You have not been previously suspended or removed from the Services;
- You are not located in a country subject to a United States, United Nations, or European Union embargo or trade restriction.
3. ACCOUNT REGISTRATION AND SECURITY
To access certain features of the Services, you must register an account via our third-party authentication provider, Clerk, Inc. ("Clerk"). You agree to:
- Provide accurate, current, and complete account information;
- Maintain and promptly update your account information;
- Maintain the confidentiality and security of your login credentials;
- Accept full responsibility for all activities that occur under your account;
- Notify us immediately of any unauthorized access or use of your account.
Kami shall not be liable for any loss or damage arising from your failure to comply with these account security obligations. We reserve the right to suspend or terminate accounts at our sole discretion.
4. DESCRIPTION OF SERVICES
Kami is a local-first, browser-based AI companion that uses WebGPU technology to run large language models entirely on your device. The core functionality of Kami operates offline within your browser; no conversation data, memories, or personal content leaves your device during normal operation.
Key characteristics of the Services include:
- Local Processing: The AI model (MLC-LLM), embedding model, and all inference run exclusively on your device's GPU using WebGPU. No AI processing occurs on remote servers.
- Local Storage: All conversation data, memories, and user data are stored in your browser's Origin Private File System (OPFS) via SQLite WASM. Kami does not operate cloud storage for user data.
- Authentication: User authentication is handled by Clerk, a third-party service. Clerk stores and processes authentication credentials, not Kami.
- Subscription Payments: Paid subscriptions are processed through Dodo Payments, a third-party payment processor. Kami does not store or process payment card information.
- Optional Cloud Features: The "Voice Mode" feature offers an optional cloud-based speech-to-text fallback via Groq, Inc. When enabled, audio data is transmitted to Groq's servers for transcription. This is opt-in and can be disabled.
5. SUBSCRIPTIONS, FEES, AND PAYMENT
Kami offers both free (Echo) and paid subscription tiers (Kami and Kami Pro). The current subscription plans and pricing are displayed on our billing page and are incorporated into these Terms by reference.
Billing and Payment: All fees are payable in advance through Dodo Payments. By subscribing, you authorize Kami (through Dodo Payments) to charge the applicable subscription fee to your designated payment method. Fees are exclusive of applicable taxes, which you are responsible for paying.
Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled. You are responsible for all recurring charges made before cancellation takes effect.
Cancellation: You may cancel your subscription at any time through your account billing settings or by contacting us. Cancellation becomes effective at the end of your current billing period. You will retain access to paid features until the end of the period for which you have paid.
Refunds: Please refer to our Refund Policy for complete details. Generally, payments are non-refundable except as required by applicable law.
6. AI-GENERATED CONTENT DISCLAIMER
Kami generates responses using large language models running locally on your device. You acknowledge and agree that:
- AI-generated content may be inaccurate, incomplete, misleading, or inappropriate. You should independently verify any information provided by Kami before relying on it.
- Kami is not a substitute for professional advice (medical, legal, financial, psychological, or otherwise). You should not rely on Kami for professional advice of any kind.
- Kami does not guarantee the accuracy, completeness, or usefulness of any AI-generated content.
- The "personality," emotional responses, and opinions expressed by Kami are algorithmic outputs and do not represent the views, beliefs, or endorsements of Kami or its Developer.
- Kami may generate content that some users find objectionable. You use Kami at your own risk.
WARNING: Kami may occasionally produce content that is incorrect, hallucinatory, or potentially harmful. You bear sole responsibility for your interactions with the AI and any consequences resulting from your use of AI-generated content.
7. ACCEPTABLE USE
You agree to use the Services only for lawful purposes and in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to:
- Use the Services in any way that violates applicable federal, state, local, or international law or regulation;
- Use Kami to generate, distribute, or facilitate illegal content, hate speech, harassment, malware, phishing, or other harmful material;
- Attempt to reverse-engineer, decompile, or extract the source code of the Services (except as permitted by applicable law);
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services, servers, or networks;
- Exploit the AI model to produce child sexual abuse material (CSAM) or deepfake non-consensual intimate imagery (NCII);
- Use the Services for any fraudulent, deceptive, or malicious purpose.
Kami reserves the right to investigate and prosecute violations of these Terms to the fullest extent permitted by law. We may terminate or suspend your access to the Services for any violation without prior notice.
8. INTELLECTUAL PROPERTY RIGHTS
Kami's Intellectual Property: The Kami name, logo, Website, App, user interface, design elements, software code, documentation, and all related materials (collectively, the "Kami Materials") are the exclusive property of the Developer. These are protected by copyright, trademark, and other intellectual property laws of India and international treaties. All rights not expressly granted in these Terms are reserved.
Your Content: As between you and Kami, you retain all rights, title, and interest in and to the text, data, and other content that you input into the Services ("User Content"). Since Kami operates locally on your device and does not transmit your data to our servers, we do not claim ownership of your User Content.
Third-Party Models: The AI models available through Kami are open-source models developed by third parties (Meta, Microsoft, Google, Mistral AI, and others) and distributed pursuant to their respective licenses. Kami does not claim ownership of these models.
9. THIRD-PARTY SERVICES AND LINKS
The Services integrate with third-party services including:

— Groq, Inc. for optional cloud speech-to-text
— Google LLC for font distribution (Google Fonts)
These third-party services are governed by their own respective terms of service and privacy policies. Kami does not control, and expressly disclaims liability for, the content, policies, or practices of any third-party service. Your use of third-party services is at your own risk.
The Website may contain links to third-party websites. These links are provided for convenience only. Kami does not endorse and is not responsible for any third-party website or its content.
10. PRIVACY AND DATA PRACTICES
Your privacy is a core design principle of Kami. Our data practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and understood our Privacy Policy.
Key privacy principles embedded in Kami's architecture:
- All conversation data and memories are processed and stored locally on your device;
- Kami does not maintain servers that store your conversation data or memories;
- Authentication and payment data are handled by third-party processors with their own security standards;
- We use cookies and local storage for essential functionality, as described in our Cookie Policy.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
KAMI DOES NOT WARRANT THAT: (a) the Services will function uninterrupted, secure, or error-free; (b) the AI-generated content will be accurate, complete, or reliable; (c) any defects or errors will be corrected; or (d) the Services are free of viruses or other harmful components.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAMI OR THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
IN NO EVENT SHALL KAMI'S TOTAL LIABILITY TO YOU UNDER THESE TERMS EXCEED THE GREATER OF: (a) the total amount paid by you to Kami in the twelve (12) months preceding the event giving rise to liability; or (b) one hundred United States Dollars (USD $100.00). These limitations apply even if Kami has been advised of the possibility of such damages.
12. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Kami, the Developer, and their respective affiliates, officers, directors, agents, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
13. TERMINATION
These Terms are effective until terminated. You may terminate this Agreement at any time by ceasing all use of the Services and deleting your account. Kami may terminate or suspend your access to the Services, in whole or in part, at any time, with or without cause and with or without notice, effective immediately. Upon termination, your right to use the Services will immediately cease.
All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

15. DATA LOSS AND BACKUP
Since all your conversation data and memories are stored exclusively in your browser's local storage (OPFS/SQLite), you are solely responsible for maintaining backups of your data. Kami provides an export feature that allows you to download your data as a JSON file. Kami is not responsible for any loss of data resulting from browser cache clearing, device failure, operating system updates, browser updates, or any other cause of data loss. You are strongly advised to regularly export and back up your data.
16. DEVICE AND BROWSER REQUIREMENTS
Kami requires a device with a modern GPU that supports WebGPU, running a compatible browser (Chrome 120+, Edge 120+, or Opera 106+). Kami does not support mobile devices, Safari, Firefox, or devices without WebGPU-capable GPUs. Kami makes no guarantee that the Services will function on all devices or browsers. Performance varies based on your device's GPU capabilities, VRAM, and available system resources.
17. MODIFICATIONS TO THESE TERMS
Kami reserves the right to modify these Terms at any time at our sole discretion. When we make material changes, we will provide notice through the Website or the App, or by other reasonable means. The "Last Updated" date at the top of this page will be revised. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.
18. MISCELLANEOUS
Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and Kami regarding the Services and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to achieve its intended effect to the maximum extent possible, or severed if modification is not possible, and the remaining provisions shall remain in full force and effect.
Waiver: Kami's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights hereunder without Kami's prior written consent. Kami may assign these Terms without restriction.
Force Majeure: Kami shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet service disruptions, third-party service failures, or governmental action.
